A retired Moonbat Professor decided she didn't like all the campaign mailings she got from her Congresswoman. [Source]
Kathleen Ensz, 63, a former teacher at the University of Northern Colorado, was arrested last summer after she wrapped one of Musgrave's campaign brochures around some dog excrement and stuffed the package under the door at the Congresswoman's office in west Greeley. Unfortunately for Ensz, police were able to trace a partial address on the mailer and she was later arrested for "use of a noxious substance." It's a class 3 misdemeanor, punishable by a fine, jail or both.
It doesn't need to be said that Ms. Ensz is a Democrat and Ms. Musgrave is a Republican. Ms. Musgrave filed a complaint and yes, Ms. Ensz is fighting the charge. She admits to delivering the package, but she claims it is protected speech under the First Amendment.
[Shannon] Lyons (Ms. Ensz' attorney) said he hired a Constitutional expert, Denver attorney Patricia S. Bangert, to argue the case for First Amendment rights. Bangert wrote a motion Tuesday, stating "Ms. Ensz's action in returning an unwanted mailing from Congresswoman Musgrave ... with a piece of feces, was expressive conduct protected by the First Amendment." Bangert also contended that Ensz couldn't receive a fair trial in Greeley because of Musgrave's "prominence in the community and government."
That's right, this retired French professor is claiming that she has a right to wrap up a a steaming pile of dog feces in some campaign literature and deposit it under someone's door. How adult of her!
The Denver attorney also contested the charge, "use of a noxious substance," as vague and unintelligible for the average person.
I dunno. I'm an average guy and I got a 100 pound big, black Lab mix (We were never told what lab he was mixed in or what they mixed in that lab!) named Bear and I can tell ya, what comes out his southern end would most certainly qualify for noxious. To state it mildly, it would gag a maggot off a gut wagon. I'd say dog crap would definitely be one of my top five on the noxious list. I don't need a lawyer to figure it out and I'm guessing if you are smart enough to read this, you probably have a pretty good handle on that dog poo and noxious substance connection as well.
I will concede that this is minor. I will concede it is way overblown, but there is a principle here that needs to be addressed.
You do not have the right to deliver dog poo to protest something. We have free speech, we do not have irresponsible speech and that is the difference this idiot professor and her twit lawyers either don't get or find it politically inconvenient. It's juvenile, it's gross and no one should feel like that is something they can freely do.
If the judge has any damned sense he'll throw out that first amendment defense crap and beat the difference between free and irresponsible into all three of their heads with his gavel. The he should fine them all for being frivolous and sentence Ms. Ensz to a day of cleaning up all the dog and goose poo she finds at the local park.
Ms. Ensz proves once again that having an education doesn't necessarily mean you have the brains to pour water out of a boot if the instructions were printed on the heel.

Litigating something like this is so American. In Canada the politician would've laughed it off for the ridiculous stunt it was and so would the populace after hearing about it on the six o'clock news. Ms. Musgrave needs to get a sense of humor and Ms. Ensz needs to find something more constructive to do with her retirment time. They both take themselves waaaaay to seriously. Pathetic.

Canuckistani ~ I'm afraid you've hit the nail on the head. I've been saying for years that too many folks here have lost their sense of humor. But then when everything is "an issue" and everyone is a "victim", I guess it's hard to find something to laugh at. Especially themselves! Good Grief, the human race is just one silly thang after another!

I suppose I really have to agree with you both.
Now that it has escalated, I would still maintain that Ms. Ensz is an idiot and this is not a free speech issue. I suppose it's also her money to waste on high priced lawyers.
