Say you arrest a guy for the brutal rape, torture and murder of a woman. Let’s also say that he tried to slit another woman’s throat. Also let’s say that he turns himself in after that. And let’s say that he confessed to his crimes, and that there were no legal problems with the arrest, confession and subsequent trial. It was one of those cases that just seemed to go so smooth. After the trial came sentencing and because this guy’s crime is so heinous, the jury gives him the death penalty. Again, everything is by the book. This guy is toast. Bye-Bye. See ya around the morgue.
Maybe.
You didn’t factor in the 9th Circus Court of Appeals, the most overturned court in the land. They overturned this scum sucking vomit chunk’s death sentence.
From KGW:
Cal Coburn Brown was in line to be the next person executed in Washington state before the three-judge panel of the 9th U.S. Circuit Court of Appeals overturned the sentence, saying a potential juror was improperly excluded.
Even though (from KING5):
His death penalty conviction was overturned because of someone who wasn't in the King County courtroom during trial -- a potential juror who the prosecutor, judge and defense all agreed was unqualified to sit for a death penalty case.
But the 9th Circus, in there infinite wisdom, decided this guy was improperly excluded. What am I missing here? The trial judge, the defense and the prosecutor all gave this one guy a pass and the appeals court says they should have seated him?
Does this mean we need an appellate judge at every Voir Dire to pick the juries?
At what point do we finally stop this madness. I hope the US Supreme Court, with Chief Justice Roberts leading the way, shoves this right back down the 9th Circus' collective throats and overturns their ruling.
Thanks to Wizbang for the open Trackbacks.
MERRY CHRISTMAS!

Everyone may not agree w/ the 9th but it is good and it forces people to do their jobs correctly. I personally wouldn't agree in a case like this. If they had evidence and he admitted guilt, I would fry the scum bag.
